Terms & Conditions
By making any payment or portion of payment to us, you irrevocably agree to the following:
Payments are non-refundable, but the event may be changed one time to a mutually agreeable date and time within three months of the original scheduled event. If you request services that are outside the normal scope of work performed by Trivia NYC, such as more than one re-writing of question rounds at your request, we shall inform you in advance that those out-of-scope services will incur additional charges at a rate of $150 per hour and await your approval. Payment for any agreed-upon out-of-scope services shall be made prior to the event start. If there are more players than the agreed maximum above, you agree that you shall pay for these additional players at a pro-rata rate.
You acknowledge that the performance of our host and the questions and answers that we provide during this event are not meant for use or dissemination outside of this event or other events of our choosing. You agree that you shall not record, use, or disseminate any of our content. You also agree to keep confidential the terms of this agreement from any other parties.
All aspects of our work for hire shall be governed by and construed in accordance with the laws of the State of New York. Any dispute relating to this work for hire shall be submitted to arbitration in accordance with the commercial rules of the American Arbitration Association then in effect; provided, that damages awarded in arbitration shall be limited to actual losses in compensation, fees, and expenses. Damages awarded to you shall be limited to material breaches of this agreement by us and to cash fees received by us from you after such material breach. The arbitration shall be held in Queens County, New York. You shall pay or reimburse us for all costs and expenses (including arbitration and court costs and attorney's fees) incurred by us as a result of any claim, action or proceeding against us if we are the prevailing party with respect to such claim, action or proceeding, as determined by the arbitrator (or judge in the case that an action or proceeding is brought to enforce or confirm the results of an arbitration award under this agreement).
You and we, each on its or their own behalf and, to the extent permitted by applicable law, on behalf of any affiliates, employees, and agents, hereby irrevocably waive any right that it may have to a trial by jury in respect of any claim, counter-claim or action based on or arising out of this Agreement.
